The "Notice" Situation: Unless otherwise specified in the leasing contract, a landlord must give his tenant notice and three days’ time to vacate before he can file a forcible detainer lawsuit. Notice must be in writing and should include a brief summation of the cause for eviction. A landlord can request varying degrees of remedies including payment for what it past due, acceleration of future payments, or termination of contract with other available remedies at law.
